City Attorney Rules Against Council Over Landing Site

The acting city attorney has sided with the mayor in a dispute over acquiring a landing-site for balloons.
Deputy City Attorney Pete Dinelli, who's filling in for the regular city attorney, Bob White, issued the opinion Monday. It's in response to councilors' voting to acquire land on their own, without involving the mayor.
That "is a clear violation of the City Charter and should be vetoed as an infringement upon the executive authority of the mayor," Dinelli said.
The resolution— sponsored by Debbie O'Malley and adopted unanimously last week— appropriated about $5 million to acquire 22 acres near Vista del Norte and Osuna. It authorized the council's president to sign such an agreement.
The mayor contended the council president doesn't have that authority.
